1. About Our Services

Baobab Story Works creates personalized digital products, including but not limited to:

• Custom children's ebooks

• Personalized wildlife and lodge-themed ebooks

• Custom birthday invitations

• Personalized digital artwork and related products

All products are delivered in digital format unless otherwise stated.

2. Eligibility

By placing an order, you confirm that:

• You are at least 18 years old or have the authority to enter into a legally binding agreement.

• Any information you provide is accurate and complete.

• You have the legal right to submit any photographs, names, or other content provided to us.

3. Photo Submission and Consent

By submitting photographs and placing an order, you confirm that:

• You are the parent, legal guardian, or authorized representative of any child depicted in the submitted images, or you have obtained the necessary permission to submit those images.

• You grant Baobab Story Works permission to use the submitted photographs solely for the purpose of creating and delivering your requested custom product.

• You understand that this permission is limited to the completion of your order and does not authorize any marketing or promotional use.

Baobab Story Works will not use customer photographs, names, or personal information for advertising, promotional activities, portfolio displays, social media content, or any other public purpose without separate written consent.

4. Customer Responsibilities

You agree not to submit content that:

• Infringes any copyright, trademark, or intellectual property rights.

• Is unlawful, defamatory, threatening, discriminatory, or abusive.

• Contains inappropriate content involving minors.

• Violates any applicable law or regulation.

We reserve the right to refuse any order that violates these requirements.

5. Orders and Production

Orders will begin once all required information, photographs, and payment have been received.

Production timelines are estimates only and may vary depending on workload, project complexity, or delays in receiving information from the customer.

We are not responsible for delays caused by incomplete or inaccurate information supplied by the customer.

6. Revisions

Unless otherwise specified, custom projects include up to two reasonable revision requests.

Additional revisions may incur additional charges.

Requests that substantially change the original brief may be treated as a new project and quoted separately.

7. Pricing and Payment

All prices displayed on our website are subject to change without notice.

Full payment is required before work begins unless alternative arrangements have been agreed to in writing.

All payments are processed using approved payment methods offered by Baobab Story Works.

8. Refund Policy

Due to the personalized nature of our products, completed custom orders are generally non-refundable.

Refunds may be considered in the following circumstances:

• Work has not yet commenced.

• Baobab Story Works is unable to complete the project.

• A refund is required under applicable law.

Once a completed digital product has been delivered, refunds will normally not be granted.

9. Delivery of Digital Products

All products are delivered electronically.

Customers are responsible for providing a valid email address and ensuring they can receive digital files.

Baobab Story Works is not responsible for delivery issues caused by incorrect email addresses supplied by the customer.

10. Intellectual Property

All website content, branding, logos, artwork, designs, templates, story concepts, text, graphics, and creative materials produced by Baobab Story Works remain the intellectual property of Baobab Story Works unless otherwise agreed in writing.

Customers retain ownership of photographs and content they submit.

Customers receive a non-exclusive, non-transferable license to use the completed product for personal, non-commercial purposes.

Products may not be resold, redistributed, reproduced for commercial purposes, or claimed as original works without written permission.

11. Privacy and Data Protection

We respect your privacy and handle personal information in accordance with our Privacy Policy and applicable South African privacy laws.

Photographs and personal information provided for custom projects are used solely for fulfilling customer orders.

Images and personal information are retained only as long as reasonably necessary to complete the project, provide customer support, comply with legal obligations, or resolve disputes.

Customers may request deletion of their personal information where permitted by law.

12. AI-Assisted Creative Content

Illustrations, artwork, or creative elements may be created or enhanced using artificial intelligence tools and subsequently reviewed, edited, and assembled by Baobab Story Works.

The final delivered product is a custom creative work produced specifically for the customer.

13. Limitation of Liability

To the fullest extent permitted by law, Baobab Story Works shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our website, services, or products.

Our total liability for any claim shall not exceed the amount paid by the customer for the specific order giving rise to the claim.

14. Website Availability

We make reasonable efforts to maintain website availability but do not guarantee uninterrupted access.

We reserve the right to modify, suspend, or discontinue any part of our website or services at any time without prior notice.

15. Changes to These Terms

We may update these Terms from time to time.

The latest version will always be published on our website with the revised effective date.

Continued use of our website or services constitutes acceptance of any updated Terms.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
